§1 Preliminary provisions

BECHTOLD is an online store, available at https://bechtold.pl, whose owner is Magdalena Bechtold, who runs the business under the name BECHTOLD & CO MAGDALENA BECHTOLD, registered in the Central Business Register and Information maintained by the Minister of Development, Labour and Technology.
These Terms and Conditions set out the rules and conditions for the conclusion and termination of Sale Agreements with the Consumer and contractors, hereinafter referred to as Customers, using services provided by the Store.
These Terms and Conditions set out the rules for the complaint procedure, as well as for the use of services provided electronically.

§2Definitions

Consumer – a natural person who enters into an agreement with the Seller at the Store, not directly related to their business or professional activities.
Seller – BECHTOLD & CO MAGDALENA BECHTOLD with its registered office in Łódź, ul.
Jana 17, postal code 91-350, NIP 726-124-95-58, REGON 472872616.
Customer – any entity making a purchase through the Store.
Store – the online store operated by the Seller at https://bechtold.pl.
Remote Agreement – an agreement concluded with the Customer remotely (within the Store), without the simultaneous physical presence of the parties in one place, with the exclusive use of one or more means of remote communication until the conclusion of the agreement.
Terms and Conditions – these terms and conditions of the Store.
Order – Customer’s declaration of will placed via the Order Form and aiming directly at concluding a Sale Agreement for a Product or Products with the Seller.
Order Form – an interactive form available in the Store that allows users to place an Order.
Product – goods or a service available in the Store, which is the subject of a Sale Agreement between the Customer and the Seller.
Sale Agreement – an agreement of sale of a Product concluded between the Customer and the Seller via the Online Store.

The Customer may communicate with the Seller using the addresses and telephone numbers provided in this paragraph.
The Customer may communicate with the Seller by phone between 9:00 a.m. and 5:00 p.m.

§4 General information

Prices given in the Store are expressed in Polish currency and are gross prices (including VAT) or in other selected currencies.
The final amount to be paid by the Customer consists of the price for the Product and the cost of shipment (including transport, delivery, and postal charges), which the Customer is informed about on the Store website during the process of placing the Order,
including at the moment of expressing the will to be bound by the Sale Agreement.
Services provided electronically allow the Customer to use the Store free of charge, as well as to make purchases through the Store website.
The Seller allows the Customer to create a user account on the Store website, which the Customer can access and update at any time, as well as providing them with the right to delete the account without any consequences.

§5Procedure for concluding a Sale Agreement

In order to conclude a Sale Agreement via the Store, the customer should go to the Store website address and submit a request by filling out the order form.
The binding and final price is the price at the time the Customer places the order.
Payment for the ordered goods can be made in the forms of payment selectable in the order form.

§6 The right to withdraw from the Agreement

The Consumer has the right to withdraw from the Agreement without giving any reason by submitting an appropriate declaration within 14 days by sending it to the address provided in these Terms and Conditions.
The 14-day period is counted from the date on which the Product was delivered.
The deadline will be met if the Consumer sends the Product back within 14 days.
The right to withdraw from the Agreement by the Consumer is excluded in the case of a Product with individual properties specified by the Consumer in the order placed by them, i.e. manufactured according to the consumer’s specifications or serving to satisfy their individual needs.
Such products are marked in the store as Product available on request or other than “In delivery” and “In stock”

Consequences of withdrawal from the Agreement:
a. In the event of withdrawal from the Agreement, the Seller shall promptly, not later than within 14 days from the receipt of the Consumer’s declaration of withdrawal from the Agreement, reimburse the payments made by them, with the exception of delivery costs.
b. The reimbursement will be made by the Seller using the same payment methods that were used by the Consumer in the original transaction, unless the Consumer expressly agreed to a different solution.
c. The Seller may withhold the reimbursement until the time of Product receipt or until proof of its return is provided to them.

§6 Complaint

The Sale Agreement covers new Products, unless otherwise stated on the Product page.
The Seller is obliged to deliver to the Customer a product free from defects.
In case of a defect in a Product purchased from the Seller, the Customer has the right to make a complaint based on the warranty provisions of the Civil Code.
Complaints should be submitted in writing or by e-mail to the Seller’s addresses given in these Terms and Conditions.
It is recommended that the complaint includes, but is not limited to
a brief description of the defect, the circumstances
(including the date) in which it occurred, the details of the Customer making the complaint, including contact details, and the Customer’s request in relation to the defective goods.
The Seller shall respond to the complaint request immediately, no later than within 14 days.
Goods sent back under the complaint procedure should be sent to the address given in §3 of these Terms and Conditions.

§7 Application of consumer legislation

The provisions concerning the consumer contained in these Terms and Conditions shall apply to any natural person concluding an agreement directly related to their business activity, where the content of this agreement indicates that it is not of professional nature for this person, resulting in particular from the subject of their business activity, made available on the basis of the provisions of the Central Business Register and Information.

§8 Personal data

The Controller of the Customers’ personal data collected through the Store is the Seller.
Customers’ personal data collected by the controller through the Store are collected in order to implement the Sale Agreement.
Recipients of the Store customers’ personal data may include selected Carriers or agents carrying out shipments on behalf of the Controller, as well as the entity handling the selected payment methods. The Customer has the right to access the content of their data, as well as the right to change or delete them.
Providing personal data of the Customer is voluntary, however it is necessary for the execution of the Sale Agreement.

§9 Final provisions

Agreements concluded through the Online Store are concluded in Polish or another language of your choice.
The Seller reserves the right to make changes to the Terms and Conditions for important reasons, such as: changes in laws, changes in methods of payment and delivery.
Any disputes that may arise during the use of Store services, the parties agree to resolve amicably, and in case of failure to reach an agreement, to submit to the settlement of the competent common court for the seat of the Seller.
The provisions of these Terms and Conditions are not intended to violate any of the Customer’s rights under the law.
Complaint
The Sale Agreement covers new Products, unless otherwise stated on the Product page.

Step 1. Go to the Store website.

Step 2. Fill out the complaint form taking into account:
a detailed description of the damage
the circumstances (including date) of the damage
goods life-time
Customer’s details (including contact details)
Customer’s request due to a defect in the goods
a copy of the receipt or other document confirming the purchase of goods in the Store
a brief description of the condition of the damaged goods packaging (upon return)
