{"id":24651,"date":"2020-10-17T13:51:17","date_gmt":"2020-10-17T11:51:17","guid":{"rendered":"https:\/\/bechtold.pl\/?page_id=24651"},"modified":"2022-11-12T10:00:55","modified_gmt":"2022-11-12T09:00:55","slug":"online-store-terms-and-conditions","status":"publish","type":"page","link":"https:\/\/bechtold.pl\/en\/online-store-terms-and-conditions\/","title":{"rendered":"Online Store Terms and Conditions"},"content":{"rendered":"<p><strong>\u00a71 Preliminary provisions<\/strong><\/p>\n<p>BECHTOLD is an online store, available at https:\/\/bechtold.pl, whose owner is Magdalena Bechtold, who runs the business under the name BECHTOLD &amp; CO MAGDALENA BECHTOLD, registered in the Central Business Register and Information maintained by the Minister of Development, Labour and Technology.<br \/>\nThese Terms and Conditions set out the rules and conditions for the conclusion and termination of Sale Agreements with the Consumer and contractors, hereinafter referred to as Customers, using services provided by the Store.<br \/>\nThese Terms and Conditions set out the rules for the complaint procedure, as well as for the use of services provided electronically.<\/p>\n<p><strong>\u00a72Definitions<\/strong><\/p>\n<p><strong>Consumer<\/strong> \u2013 a natural person who enters into an agreement with the Seller at the Store, not directly related to their business or professional activities.<br \/>\n<strong>Seller<\/strong> \u2013 BECHTOLD &amp; CO MAGDALENA BECHTOLD with its registered office in \u0141\u00f3d\u017a, ul.<br \/>\nJana 17, postal code 91-350, NIP 726-124-95-58, REGON 472872616.<br \/>\n<strong>Customer<\/strong> \u2013 any entity making a purchase through the Store.<br \/>\n<strong>Store<\/strong> \u2013 the online store operated by the Seller at https:\/\/bechtold.pl.<br \/>\n<strong>Remote Agreement<\/strong> \u2013 an agreement concluded with the Customer remotely (within the Store), without the simultaneous physical presence of the parties in one place, with the exclusive use of one or more means of remote communication until the conclusion of the agreement.<br \/>\n<strong>Terms and Conditions<\/strong> \u2013 these terms and conditions of the Store.<br \/>\n<strong>Order<\/strong> \u2013 Customer&#8217;s declaration of will placed via the Order Form and aiming directly at concluding a Sale Agreement for a Product or Products with the Seller.<br \/>\n<strong>Order Form<\/strong> \u2013 an interactive form available in the Store that allows users to place an Order.<br \/>\n<strong>Product<\/strong> \u2013 goods or a service available in the Store, which is the subject of a Sale Agreement between the Customer and the Seller.<br \/>\n<strong>Sale Agreement<\/strong> \u2013 an agreement of sale of a Product concluded between the Customer and the Seller via the Online Store.<\/p>\n<p><strong>\u00a73\u00a0Contact with the Store<\/strong><\/p>\n<p>Seller\u2019s Address: ul. Li\u015bciasta 17, 91-357 \u0141\u00f3d\u017a<br \/>\nSeller&#8217;s e-mail address: <strong>bechtold@bechtold.pl<\/strong><br \/>\nSeller&#8217;s phone number: (0-42) 616 53 61; (0-501) 546 461<br \/>\nFax number: <strong>(0-42) 616 55 61<\/strong><br \/>\nSeller&#8217;s bank account number:<br \/>\n62 1050 1461 1000 0022 8405 1311 EUR<br \/>\n02 1050 1461 1000 0022 4706 6679 PLN<br \/>\n94 1050 1461 1000 0022 9192 3643 USD<br \/>\nThe Customer may communicate with the Seller using the addresses and telephone numbers provided in this paragraph.<br \/>\nThe Customer may communicate with the Seller by phone between <strong>9:00 a.m. and 5:00 p.m<\/strong>.<\/p>\n<p><strong>\u00a74 General information<\/strong><\/p>\n<p>Prices given in the Store are expressed in Polish currency and are gross prices (including VAT) or in other selected currencies.<br \/>\nThe final amount to be paid by the Customer consists of the price for the Product and the cost of shipment (including transport, delivery, and postal charges), which the Customer is informed about on the Store website during the process of placing the Order,<br \/>\nincluding at the moment of expressing the will to be bound by the Sale Agreement.<br \/>\nServices provided electronically allow the Customer to use the Store free of charge, as well as to make purchases through the Store website.<br \/>\nThe Seller allows the Customer to create a user account on the Store website, which the Customer can access and update at any time, as well as providing them with the right to delete the account without any consequences.<\/p>\n<p><strong>\u00a75Procedure for concluding a Sale Agreement<\/strong><\/p>\n<p>In order to conclude a Sale Agreement via the Store, the customer should go to the Store website address and submit a request by filling out the order form.<br \/>\nThe binding and final price is the price at the time the Customer places the order.<br \/>\nPayment for the ordered goods can be made in the forms of payment selectable in the order form.<\/p>\n<p><strong>\u00a76 The right to withdraw from the Agreement<\/strong><\/p>\n<p>The Consumer has the right to withdraw from the Agreement without giving any reason by submitting an appropriate declaration within 14 days by sending it to the address provided in these Terms and Conditions.<br \/>\nThe 14-day period is counted from the date on which the Product was delivered.<br \/>\nThe deadline will be met if the Consumer sends the Product back within 14 days.<br \/>\nThe right to withdraw from the Agreement by the Consumer is excluded in the case of a Product with individual properties specified by the Consumer in the order placed by them, i.e. manufactured according to the consumer&#8217;s specifications or serving to satisfy their individual needs.<br \/>\nSuch products are marked in the store as Product available on request or other than &#8220;In delivery&#8221; and &#8220;In stock&#8221;<\/p>\n<p>Consequences of withdrawal from the Agreement:<br \/>\na. In the event of withdrawal from the Agreement, the Seller shall promptly, not later than within 14 days from the receipt of the Consumer&#8217;s declaration of withdrawal from the Agreement, reimburse the payments made by them, with the exception of delivery costs.<br \/>\nb. The reimbursement will be made by the Seller using the same payment methods that were used by the Consumer in the original transaction, unless the Consumer expressly agreed to a different solution.<br \/>\nc. The Seller may withhold the reimbursement until the time of Product receipt or until proof of its return is provided to them.<\/p>\n<p><strong>\u00a76 Complaint<\/strong><\/p>\n<p>The Sale Agreement covers new Products, unless otherwise stated on the Product page.<br \/>\nThe Seller is obliged to deliver to the Customer a product free from defects.<br \/>\nIn case of a defect in a Product purchased from the Seller, the Customer has the right to make a complaint based on the warranty provisions of the Civil Code.<br \/>\nComplaints should be submitted in writing or by e-mail to the Seller&#8217;s addresses given in these Terms and Conditions.<br \/>\nIt is recommended that the complaint includes, but is not limited to<br \/>\na brief description of the defect, the circumstances<br \/>\n(including the date) in which it occurred, the details of the Customer making the complaint, including contact details, and the Customer&#8217;s request in relation to the defective goods.<br \/>\nThe Seller shall respond to the complaint request immediately, no later than within 14 days.<br \/>\nGoods sent back under the complaint procedure should be sent to the address given in \u00a73 of these Terms and Conditions.<\/p>\n<p><strong>\u00a77 Application of consumer legislation<\/strong><\/p>\n<p>The provisions concerning the consumer contained in these Terms and Conditions shall apply to any natural person concluding an agreement directly related to their business activity, where the content of this agreement indicates that it is not of professional nature for this person, resulting in particular from the subject of their business activity, made available on the basis of the provisions of the Central Business Register and Information.<\/p>\n<p><strong>\u00a78 Personal data<\/strong><\/p>\n<p>The Controller of the Customers&#8217; personal data collected through the Store is the Seller.<br \/>\nCustomers&#8217; personal data collected by the controller through the Store are collected in order to implement the Sale Agreement.<br \/>\nRecipients of the Store customers&#8217; personal data may include selected Carriers or agents carrying out shipments on behalf of the Controller, as well as the entity handling the selected payment methods. The Customer has the right to access the content of their data, as well as the right to change or delete them.<br \/>\nProviding personal data of the Customer is voluntary, however it is necessary for the execution of the Sale Agreement.<\/p>\n<p><strong>\u00a79 Final provisions<\/strong><\/p>\n<p>Agreements concluded through the Online Store are concluded in Polish or another language of your choice.<br \/>\nThe Seller reserves the right to make changes to the Terms and Conditions for important reasons, such as: changes in laws, changes in methods of payment and delivery.<br \/>\nAny disputes that may arise during the use of Store services, the parties agree to resolve amicably, and in case of failure to reach an agreement, to submit to the settlement of the competent common court for the seat of the Seller.<br \/>\nThe provisions of these Terms and Conditions are not intended to violate any of the Customer&#8217;s rights under the law.<br \/>\nComplaint<br \/>\nThe Sale Agreement covers new Products, unless otherwise stated on the Product page.<br \/>\nThe Seller is obliged to deliver to the Customer a product free from defects.<br \/>\nIn case of a defect in a Product purchased from the Seller, the Customer has the right to make a complaint based on the warranty provisions of the Civil Code.<br \/>\nComplaints should be submitted in writing or by e-mail to the Seller&#8217;s addresses given in the Terms and Conditions.<br \/>\nIt is recommended that the complaint includes, but is not limited to<br \/>\na brief description of the defect, the circumstances (including the date) in which it occurred, the details of the Customer making the complaint, including contact details, and the Customer&#8217;s request in relation to the defective goods.<br \/>\nThe Seller shall respond to the complaint request immediately, no later than within 14 days.<br \/>\nGoods sent back under the complaint procedure should be sent to the address given in \u00a73 of Terms and Conditions. How to make a complaint step by step<\/p>\n<p><strong>Step 1.<\/strong> Go to the Store website.<\/p>\n<p><strong>Step 2.<\/strong> Fill out the complaint form taking into account:<br \/>\na detailed description of the damage<br \/>\nthe circumstances (including date) of the damage<br \/>\ngoods life-time<br \/>\nCustomer\u2019s details (including contact details)<br \/>\nCustomer&#8217;s request due to a defect in the goods<br \/>\na copy of the receipt or other document confirming the purchase of goods in the Store<br \/>\na brief description of the condition of the damaged goods packaging (upon return)<\/p>\n<p><strong>Step 3.<\/strong> Submit the complaint form in writing or by e-mail to the Seller&#8217;s addresses:<br \/>\nAddress: ul. Return the damaged goods, preferably in the original packaging, to the Seller&#8217;s address:<br \/>\nul.
